Adopted on the 3rd of March 2017 by the Council of the Euroasian Economic Commission (EEC), the new technical regulation in EAEU (No.41) is expected to enter into force on the 2nd of June 2021. Under this regulation, companies placing chemical substances on the Eurasian Economic Union - Russia, Belarus, Kazakhstan, Kyrgyzstan and Armenia - are required to register the so-called “new chemical substances” and existing chemical substances that are placed on the EAEU market. Like in EU REACH, Non-EAEU companies can appoint a Nominated Representative in the EAEU for the purposes of compliance with the technical regulation requirements.
As part of the EAEU regulation implementation plan, the EAEU member states will be forming their own national existing chemical substances inventories in order to eventually compile a common inventory by 2021. Meanwhile, supposedly from January 2019, companies may start registering their substances to the chemical inventories attempting to avoid more rigorous new substance registration requirements under the EAEU regulation in the future. Substances listed in the final inventory will be regarded as existing chemicals where much lighter registration requirements are applicable.
